INTRODUCTION

These Terms of Use apply to the use of the CAPITAL Connect app, owned and operated by CAPITAL vzw (hereinafter "CAPITAL", "we" or "us").

By downloading, installing or using the CAPITAL Connect app, you declare that you have read, understood and agree to the Terms of Use. If you do not agree to these Terms of Use, please do not use the CAPITAL Connect app.

These Terms of Use may be updated periodically, and we will inform you of any changes appropriately. Your continued use of the app following changes implies your acceptance of the changes. If you do not agree to the amended terms, you should discontinue using the app.

REGISTRATION AND ACCOUNT

To use the CAPITAL Connect app, you must create a personal account. You agree to provide accurate, current and complete information during registration. You are responsible for the security of your login details and for all activities that take place under your account.

You must notify CAPITAL if you become aware of:

theft or loss of your login details and password, or
unauthorised access to your user account.

PERMITTED USE

You may only use the CAPITAL Connect app for legitimate purposes in accordance with these Terms of Use. You agree to:

Not to use the CAPITAL Connect app in a manner that violates any law or regulation.
Not to upload content that is offensive, defamatory, discriminatory or otherwise inappropriate.
Not to infringe the rights of third parties, including intellectual property rights.
Not disrupt, damage, overload or interrupt the operation, security or availability of the CAPITAL Connect app, its servers, networks, or any other software, hardware or infrastructure connected to or accessible through the CAPITAL Connect app.
Do not access parts of the CAPITAL Connect app for which you do not have permission.

LIABILITY AND INDEMNITY

We try to ensure that the CAPITAL Connect app operates correctly, but we cannot guarantee its functionality, accuracy, reliability or continuity. CAPITAL does not warrant that the CAPITAL Connect app will meet your requirements in all respects or be available at all times, or that the operation of the CAPITAL Connect app will be uninterrupted or error-free. The app is provided on an "as is" and "as available" basis without any express warranties of any kind.

To the extent permitted by law, we shall not be liable for any direct, indirect, incidental or consequential damages arising from your use of the CAPITAL Connect app.

You agree to indemnify, defend and hold CAPITAL, its directors, officers, employees, agents, licensors and third-party partners harmless from and against any and all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any breach by you of these Terms of Use, any third-party rights or any applicable law or regulation to the fullest extent permitted by law.

INTELLECTUAL PROPERTY RIGHTS

All right, title and interest in the CAPITAL Connect app, including its content, software, designs and other materials, are owned by CAPITAL or licensed to us. Nothing in these Terms of Use grants you any rights to copy, distribute, modify or otherwise exploit any part of the CAPITAL Connect app without our express permission. Your right of use is limited to using the CAPITAL Connect app for its purposes.

PRIVACY

Our Privacy Policy describes how we process your personal data when you use the CAPITAL Connect app. You can access it here.

TERMINATION

We reserve the right to terminate your access to the CAPITAL Connect app at any time and without notice if we believe you are in breach of these Terms of Use or any applicable laws or regulations. You may terminate your use of the CAPITAL Connect app at any time by deleting your account and the app.

UPDATES AND CHANGES

We may make updates or changes to the CAPITAL Connect app at any time. These changes may affect the functions and performance of the CAPITAL Connect app. We may also decide to terminate all or part of the CAPITAL Connect app. In such cases, we will endeavour to notify you in a timely manner.

EXTERNAL LINKS

The CAPITAL Connect app may contain links to external websites or services that are not operated by us. We are not responsible for the content or practices of these websites and services, and your use of them is at your own risk.

OTHER PROVISIONS

To the extent permitted by law, these Terms of Use and your use of the CAPITAL Connect app shall be governed by and construed in accordance with Belgian law. To the extent permitted by law, any disputes arising out of or relating to these Terms of Use shall be submitted to the competent courts of Brussels.

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

INTRODUCTION

Les présentes conditions d'utilisation s'appliquent à l'utilisation de l'application CAPITAL Connect, détenue et exploitée par CAPITAL vzw (ci-après "CAPITAL", "nous" ou "notre").

En téléchargeant, installant ou utilisant l'application CAPITAL Connect, vous déclarez avoir lu, compris et accepté les conditions d'utilisation. Si vous n'acceptez pas ces conditions d'utilisation, veuillez ne pas utiliser l'application CAPITAL Connect.

Les présentes conditions d'utilisation peuvent être mises à jour périodiquement et nous vous informerons de tout changement de manière appropriée. En continuant à utiliser l'application après les modifications, vous acceptez ces dernières. Si vous n'acceptez pas les conditions modifiées, vous devez cesser d'utiliser l'application.

ENREGISTREMENT ET COMPTE

Pour utiliser l'application CAPITAL Connect, vous devez créer un compte personnel. Vous vous engagez à fournir des informations exactes, actuelles et complètes lors de votre inscription. Vous êtes responsable de la sécurité de vos données de connexion et de toutes les activités qui ont lieu sous votre compte.

Vous devez informer CAPITAL si vous avez connaissance :

du vol ou de la perte de vos identifiants et mot de passe, ou
de l'accès non autorisé à votre compte d'utilisateur.

UTILISATION PERMISE

Vous ne pouvez utiliser l'application CAPITAL Connect qu'à des fins légitimes, conformément aux présentes conditions d'utilisation. Vous acceptez de :

Ne pas utiliser l'application CAPITAL Connect d'une manière qui viole une loi ou un règlement.
Ne pas télécharger de contenu offensant, diffamatoire, discriminatoire ou autrement inapproprié.
Ne pas enfreindre les droits des tiers, y compris les droits de propriété intellectuelle.
Ne pas perturber, endommager, surcharger ou interrompre le fonctionnement, la sécurité ou la disponibilité de l'application CAPITAL Connect, de ses serveurs, de ses réseaux ou de tout autre logiciel, matériel ou infrastructure connecté à l'application CAPITAL Connect ou accessible par l'intermédiaire de celle-ci.
N'accédez pas aux parties de l'application CAPITAL Connect pour lesquelles vous n'avez pas l'autorisation.

RESPONSABILITÉ ET INDEMNISATION

Nous nous efforçons d'assurer le bon fonctionnement de l'application CAPITAL Connect, mais nous ne pouvons donner aucune garantie quant à sa fonctionnalité, son exactitude, sa fiabilité ou sa continuité. CAPITAL ne garantit pas que l'application CAPITAL Connect répondra à vos exigences à tous égards ou sera disponible à tout moment, ou que le fonctionnement de l'application CAPITAL Connect sera ininterrompu ou exempt d'erreurs. L'application est fournie “as is” et “as available” sans aucune garantie expresse de quelque nature que ce soit.

Dans la mesure permise par la loi, nous ne serons pas responsables des dommages directs, indirects, accessoires ou consécutifs découlant de votre utilisation de l'application CAPITAL Connect.

Vous acceptez d'indemniser, de défendre et de tenir CAPITAL, ses administrateurs, dirigeants, employés, agents, concédants de licence et partenaires tiers à l'abri de toutes pertes, dépenses, dommages et coûts, y compris les frais raisonnables d'avocat, résultant de toute violation par vous des présentes conditions d'utilisation, des droits de tiers ou de toute loi ou réglementation applicable, dans toute la mesure permise par la loi.

LES DROITS DE PROPRIÉTÉ INTELLECTUELLE

Tous les droits, titres et intérêts relatifs à l'application CAPITAL Connect, y compris son contenu, ses logiciels, ses dessins et autres matériels, sont la propriété de CAPITAL ou nous sont concédés sous licence. Aucune disposition des présentes conditions d'utilisation ne vous accorde le droit de copier, de distribuer, de modifier ou d'exploiter de quelque façon que ce soit toute partie de l'application CAPITAL Connect sans notre autorisation expresse. Votre droit d'utilisation est limité à l'utilisation de l'application CAPITAL Connect aux fins prévues.

VIE PRIVÉE

Notre politique de protection de la vie privée décrit comment nous traitons vos données personnelles lorsque vous utilisez l'application CAPITAL Connect. Vous pouvez accéder à cette politique ici.

TERMINAISON

Nous nous réservons le droit de mettre fin à votre accès à l'application CAPITAL Connect à tout moment et sans préavis si nous estimons que vous ne respectez pas les présentes conditions d'utilisation ou les lois ou règlements applicables. Vous pouvez mettre fin à votre utilisation de l'application CAPITAL Connect à tout moment en supprimant votre compte et l'application.

MISES A JOUR ET MODIFICATIONS

Nous pouvons à tout moment apporter des mises à jour ou des modifications à l'application CAPITAL Connect. Ces modifications peuvent avoir une incidence sur les fonctions et les performances de l'application CAPITAL Connect. Nous pouvons également décider de mettre fin à tout ou partie de l'application CAPITAL Connect. Dans ce cas, nous nous efforcerons de vous en informer en temps utile.

LIENS EXTERNES

L'application CAPITAL Connect peut contenir des liens vers des sites web ou des services externes qui ne sont pas exploités par nous. Nous ne sommes pas responsables du contenu ou des pratiques de ces sites web et services, et vous les utilisez à vos propres risques.

AUTRES DISPOSITIONS

Dans la mesure où la loi le permet, les présentes conditions d'utilisation et votre utilisation de l'application CAPITAL Connect sont régies et interprétées conformément au droit belge. Dans la mesure où la loi le permet, tout litige découlant des présentes conditions d'utilisation ou s'y rapportant sera soumis aux tribunaux compétents de Bruxelles.

Si l'une des dispositions des présentes conditions d'utilisation est jugée invalide ou inapplicable, les autres dispositions resteront pleinement en vigueur. Le fait que nous n'appliquions pas un droit ou une disposition ne constitue pas une renonciation à ce droit ou à cette disposition.

Gebruiksvoorwaarden

INLEIDING

Deze Gebruiksvoorwaarden zijn van toepassing op het gebruik van de CAPITAL Connect app, eigendom van en beheerd door CAPITAL vzw (hierna “CAPITAL”, “wij” of “ons”).

Door de CAPITAL Connect app te downloaden, te installeren of te gebruiken, verklaart u dat u de Gebruiksvoorwaarden gelezen en begrepen hebt en ermee akkoord gaat. Indien u niet akkoord gaat met deze Gebruiksvoorwaarden, verzoeken wij u om de CAPITAL Connect app niet te gebruiken.

Deze Gebruiksvoorwaarden kunnen periodiek worden bijgewerkt, en wij zullen u op gepaste wijze informeren over eventuele wijzigingen. Uw voortgezet gebruik van de app na wijzigingen impliceert uw aanvaarding van de wijzigingen. Indien u niet akkoord gaat met de gewijzigde voorwaarden, dient u het gebruik van de app te staken.

REGISTRATIE EN ACCOUNT

Om de CAPITAL Connect app te gebruiken, moet u een persoonlijk account aanmaken. U stemt ermee in om nauwkeurige, actuele en volledige informatie te verstrekken tijdens de registratie. U bent verantwoordelijk voor de veiligheid van uw inloggegevens en voor alle activiteiten die plaatsvinden onder uw account.

U moet CAPITAL op de hoogte stellen als u zich bewust wordt van (i) diefstal of verlies van uw inloggegevens en wachtwoord of (ii) onbevoegde toegang tot uw gebruikersaccount.

TOEGESTAAN GEBRUIK

U mag de CAPITAL Connect app alleen gebruiken voor legitieme doeleinden in overeenstemming met deze Gebruiksvoorwaarden. U stemt ermee in om:

De CAPITAL Connect app niet te gebruiken op een wijze die in strijd is met enige wet- of regelgeving.
Geen inhoud te uploaden die beledigend, lasterlijk, discriminerend of anderszins ongepast is.
Geen inbreuk te maken op de rechten van derden, inclusief intellectuele eigendomsrechten.
De werking, veiligheid of beschikbaarheid van de CAPITAL Connect app, haar servers, netwerken, of enige andere software, hardware of infrastructuur die verbonden is met of toegankelijk is via de CAPITAL Connect app, niet te verstoren, te beschadigen, te overbelasten of te onderbreken.
Geen toegang te verkrijgen tot delen van de CAPITAL Connect app waarvoor u geen toestemming hebt.

AANSPRAKELIJKHEID EN VRIJWARING

Wij proberen ervoor te zorgen dat de CAPITAL Connect app correct werkt, maar wij kunnen geen garanties geven over de functionaliteit, nauwkeurigheid, betrouwbaarheid of continuïteit ervan. CAPITAL garandeert niet dat de CAPITAL Connect app in alle opzichten aan uw eisen zal voldoen of op elk ogenblik beschikbaar zal zijn, of dat de werking van de CAPITAL Connect app ononderbroken of foutloos zal zijn. De app wordt aangeboden op een “as is” en “as available” basis zonder enige uitdrukkelijke garanties van welke aard ook.

Voor zover toegestaan door de wet, zijn wij niet aansprakelijk voor enige directe, indirecte, incidentele of gevolgschade die voortvloeit uit uw gebruik van de CAPITAL Connect app.

U gaat ermee akkoord CAPITAL, haar bestuurders, functionarissen, werknemers, agenten, licentiegevers en derden-partners schadeloos te stellen, te verdedigen en te vrijwaren tegen alle verliezen, uitgaven, schade en kosten, met inbegrip van redelijke honoraria van advocaten, die het gevolg zijn van een schending door u van deze Gebruiksvoorwaarden, van rechten van een derde partij of van een toepasselijke wet of regelgeving, voor zover toegestaan door de wet.

INTELLECTUELE EIGENDOMSRECHTEN

Alle rechten, titels en belangen in de CAPITAL Connect app, inclusief de inhoud, software, ontwerpen en andere materialen, zijn eigendom van CAPITAL of zijn gelicentieerd aan ons. Niets in deze Gebruiksvoorwaarden verleent u rechten om enig deel van de CAPITAL Connect app te kopiëren, distribueren, wijzigen of anderszins te exploiteren zonder onze uitdrukkelijke toestemming. Uw gebruiksrecht is beperkt tot het gebruik van de CAPITAL Connect app voor de doeleinden daarvan.

PRIVACY

Ons Privacybeleid beschrijft hoe wij uw persoonsgegevens verwerken wanneer u de CAPITAL Connect app gebruikt. U kan het hier raadplegen.

BEËINDIGING

Wij behouden ons het recht voor om uw toegang tot de CAPITAL Connect app op elk moment en zonder voorafgaande kennisgeving te beëindigen indien wij van mening zijn dat u in strijd handelt met deze Gebruiksvoorwaarden of enige toepasselijke wet- of regelgeving. U kunt uw gebruik van de CAPITAL Connect app op elk moment beëindigen door uw account en de app te verwijderen.

UPDATES EN WIJZIGINGEN

Wij kunnen op elk moment updates of wijzigingen aanbrengen in de CAPITAL Connect app. Deze wijzigingen kunnen van invloed zijn op de functies en prestaties van de CAPITAL Connect app. Wij kunnen ook besluiten om de CAPITAL Connect app geheel of gedeeltelijk te beëindigen. In dergelijke gevallen zullen wij proberen u tijdig op de hoogte te stellen.

EXTERNE LINKS

De CAPITAL Connect app kan links bevatten naar externe websites of diensten die niet door ons worden beheerd. Wij zijn niet verantwoordelijk voor de inhoud of praktijken van deze websites en diensten, en uw gebruik ervan is op eigen risico.

OVERIGE BEPALINGEN

Voor zover toegestaan door de wet, worden deze Gebruiksvoorwaarden en uw gebruik van de CAPITAL Connect app beheerst door en geïnterpreteerd in overeenstemming met het Belgisch recht. Voor zover toegestaan door de wet, zullen eventuele geschillen die voortvloeien uit of verband houden met deze Gebruiksvoorwaarden worden voorgelegd aan de bevoegde rechtbanken van Brussel.

Indien een bepaling van deze Gebruiksvoorwaarden ongeldig of niet-afdwingbaar blijkt te zijn, blijven de overige bepalingen volledig van kracht. Ons verzuim om enig recht of bepaling af te dwingen vormt geen verklaring van afstand van dat recht of die bepaling.
